Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your access to and use of the Laima platform ("Service"), operated by Krista Vitolska, trading as Laima, located in Latvia, European Union.
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
The Service is offered to businesses in the beauty and wellness industry, including but not limited to hair salons, nail salons, barbershops, and massage and wellness studios ("Subscribers"). Individuals who book appointments through the Service are referred to as "End Users" or "Clients."
2. Eligibility
You must be at least 18 years of age and have the legal authority to bind the business you represent. By registering, you represent that all information you provide is accurate and that you are authorised to act on behalf of the business.
3. Description of Service
Laima provides a cloud-based appointment booking and business management platform for beauty and wellness businesses. The Service includes AI-powered booking chat widget, online appointment management and calendar, client profile management with AI-assisted memory and preferences, staff scheduling and management, Google Calendar synchronisation, automated booking reminders and notifications, analytics and reporting dashboard, and payment processing integration via third-party providers (Stripe).
The AI features of the Service use artificial intelligence (powered by Anthropic's Claude) to assist with booking conversations and client interactions. AI-generated responses are provided as assistance and may not always be perfectly accurate. You acknowledge that AI interactions are automated and not human.
4. Account Registration and Security
You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at hello@getlaima.com if you become aware of any unauthorised use of your account. You are responsible for all activities that occur under your account.
5. Subscription Plans and Fees
The Service is offered under subscription plans as described on our pricing page. Plan features, limitations, and pricing may change with 30 days' notice to existing Subscribers. New Subscribers receive a 14-day free trial of the Pro plan. No payment details are required to start the trial.
Fees are charged in advance on a monthly or annual basis. All fees are quoted in British Pounds Sterling (GBP) unless otherwise stated. Payments are processed through Stripe. All fees are exclusive of applicable taxes.
If payment fails, we will notify you and provide a 7-day grace period. If payment is not received within the grace period, your account may be suspended.
6. Cancellation and Refunds
You may cancel your subscription at any time from your account settings or by contacting us at hello@getlaima.com. Upon cancellation, your account will remain active until the end of the current billing period. We offer a full refund within 14 days of your first paid subscription. After this period, fees are non-refundable.
Upon cancellation, your data will be retained for 30 days to allow for reactivation. After 30 days, your data will be permanently deleted. You may request an export of your data at any time before deletion.
7. Your Responsibilities as a Subscriber
As a Subscriber, you are the data controller for the personal data of your Clients processed through the Service. You are responsible for obtaining all necessary consents from your Clients, complying with all applicable data protection laws (UK GDPR, Australian Privacy Act, CCPA, EU GDPR), ensuring information you provide is accurate, using the Service only for lawful business purposes, and not using the Service to send unsolicited communications.
8. AI Features — Important Disclosures
The Service uses artificial intelligence to power booking conversations, client interaction summaries, and preference tracking. While we strive for accuracy, AI-generated content may contain errors. You should review AI-generated booking confirmations and client communications.
Booking conversations processed by the AI are sent to our AI provider (Anthropic) for processing. No conversation data is used to train AI models. Conversations are processed in real-time and not stored by the AI provider beyond the duration of the interaction.
9. Intellectual Property
The Service, including its design, code, features, and documentation, is owned by us. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the Service. You retain ownership of all content you submit. Client data entered or generated through the Service belongs to you as the data controller.
10. Prohibited Uses
You agree not to use the Service for any unlawful purpose, attempt to reverse engineer the Service, interfere with performance, attempt unauthorised access, transmit harmful code, resell the Service without consent, or manipulate AI features to generate harmful content.
11. Third-Party Services
The Service integrates with Stripe (payment processing), Google Calendar (calendar synchronisation), and Anthropic (AI processing). Your use of these integrations is subject to the respective third-party terms.
12. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. Support is available via email at hello@getlaima.com. We aim to respond within 24 hours on business days.
13. Limitation of Liability
The Service is provided "as is" and "as available." Our total aggregate liability shall not exceed the total fees paid by you in the 12 months preceding the claim. We shall not be liable for indirect, incidental, special, consequential, or punitive damages. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by applicable law.
14. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses arising from your use of the Service, your violation of these Terms, or your violation of any applicable law.
15. Modifications
We may update these Terms from time to time with at least 30 days' notice. Your continued use after the effective date constitutes acceptance.
16. Termination
You may terminate your account at any time. We may suspend or terminate your account for breach of Terms, failure to pay, harmful use, or legal requirement. Upon termination, your right to use the Service ceases immediately.
17. Governing Law
These Terms are governed by the laws of the Republic of Latvia. Any dispute shall first be attempted through good-faith negotiation. Nothing in these Terms affects your statutory consumer rights under UK, Australian, or EU law.
